Terms and Conditions

  1. The Property is let for holiday accommodation purposes only.
     
  2. Bookings are for the dates as shown on the response email, letter or receipt provided to you by SEJ and are taken in good faith by SEJ however bookings may be subject to change prior to the commencement of the booking. All advance deposits are accepted on behalf of the owner of the Property and SEJ accepts no responsibility for any decision, action or arrangement of the owner of the Property (at the time of booking) or any subsequent owner of the Property, including but not limited to, the sale of the Property, the withdrawal from rental, the Property being rendered uninhabitable, a change in the accommodation fee or the alteration of the Property in any way prior to your occupation.
     
  3. SEJ reserves the right to cancel a booking for any reason which, in SEJ’s opinion, renders the booking impractical. SEJ will attempt to notify you as soon as possible and to use its reasonable endeavours to arrange alternative accommodation or dates suitable to you, failing which all monies paid by you will be refunded, but no other claim, right, action or demand shall exist in or be made by you against SEJ.
     
  4. The Property will be available after 2.00pm on the day of your arrival and you must vacate the Property by 10:00am on the day of your departure, unless you have made other arrangements with SEJ prior to your arrival. Failure to vacate the Property on time will result in one extra nights’ accommodation fee being charged to your credit card.
     
  5. Smoking is strictly prohibited inside the Property.
     
  6. Dogs and any other pets are not allowed at the Property under any circumstances, unless the Property is a designated “pet friendly” property and your pet has been approved by SEJ prior to your arrival. All pet faeces, hair, food and any other mess caused by your pet must be removed before your departure. If there is any evidence of your pet, including any damage caused by your pet, after you depart the Property, a fee will be charged for cleaning and/or repairing the Property. If unauthorised pets are found at the Property, your booking will be terminated immediately and no refund will be issued.
     
  7. Tents, caravans and the like are strictly not permitted at the Property at any time.
     
  8. All holiday rental properties are fully equipped with the exception of linen which is not provided unless specified in writing (e.g. sheets, pillow cases, towels, bath mats, tea towels, tablecloths etc). A small complimentary supply of cleaning products (soap, detergent etc) is supplied.
     
  9. Unless otherwise specified in writing, firewood for wood heaters is not supplied. Wood is available to purchase from the Sandy Point general store, Foster or Fish Creek.
     
  10. The maximum number of persons (including children) permitted to occupy the Property is included in the property description. Overcrowding, extra guests and parties are not allowed. If there is evidence of overcrowding, extra guests or parties at the Property at any time, the booking will be terminated immediately, all moneys forfeited and any costs incurred as a result of the misuse of the Property will be payable by you or charged against the credit card tendered.
     
  11. SEJ will only confirm a booking request where the full deposit amount requested is received by the due date. Please choose your booking carefully as deposits are not transferable or refundable except as otherwise provided in these Terms and Conditions. The balance of your accommodation fee must be paid by the 1st of August each year for all bookings during the peak summer period, 30 days prior to arrival for other peak periods such as long weekends, and 14 days prior to your arrival for off peak bookings.
     
  12. Payments can be made by bank transfer, cheque or credit card. Cheques are not accepted for bookings commencing within 10 business days of the date of booking the Property and a fee for dishonoured cheques will be payable by you.
     
  13. Cancellations for bookings over peak holiday times (school holidays, Easter and long weekends) are refunded only when the Property is fully re-let for the same period at the same or greater accommodation fee. Cancellations for bookings outside these times are refunded only when the cancellation is made at least 14 days prior to the original arrival date. All cancellations must be in writing. No refund of any unused portion of a confirmed booking will be made for early departures or non-arrivals. Travel insurance is recommended, particularly for high-cost bookings. Please note: A change of booking dates attracts the same conditions as for cancellations.
     
  14. A Guest Information Form must be completed, signed and returned for each booking 5 days prior to arrival. We also require a copy of Photo ID
     
  15. Information regarding key pick up will be included with the receipt issued to you for your final balance payment. If you intend to arrive after hours, please notify SEJ’s office. Under no circumstances will keys be left out for collection without prior arrangement, and SEJ must have already received full payment of your accommodation fee and a signed Guest Information Form. SEJ will not be responsible for alternative accommodation or any other costs incurred if you arrive after hours without prior notice to SEJ.
     
  16. If upon your arrival the Property is not clean, or it comes to your attention that the Property has been damaged, you must promptly notify SEJ and allow SEJ, its agents, contractors or employees access to the Property for the purposes of inspection and, if necessary, cleaning or repairing the damage. To the maximum extent permitted by law, no refunds or compensation will be provided for any damage or issues that were not promptly reported to SEJ’s office.
     
  17. SEJ is not responsible for, and you hereby release SEJ from, any liability in respect of any injury, debt, damage, loss, cost, delay, expense or inconvenience caused directly or indirectly by your occupation or use of the Property.
     
  18. SEJ accepts no responsibility for guests’ personal property left in, on or near the Property. Doors and windows at the Property should be secured at ALL times. It is recommended that you take out personal property insurance. You will be responsible for all postage costs associated with returning items left at the Property.
     
  19. By accepting this booking you agree that if you or any occupant covered by your booking, including any of your guests or visitors, breaches these Terms and Conditions or causes any damage to the Property, your name, telephone number, email address, as well as details of the breach or damage, may be retained by SEJ in accordance with SEJ’s privacy policy and to the extent permitted by law provided to the Property’s owner. You also agree that SEJ may refuse or cancel any future bookings made by you.
     
  20. Occupation or use of the Property which, in SEJ’s opinion, causes a nuisance or annoyance to neighbouring or adjoining occupiers or properties will be terminated immediately, all moneys forfeited and any costs incurred following misuse of or damage to the Property will be payable by you or charged to the credit card tendered. Strictly NO SCHOOLIES or BUCKS/HENS NIGHTS.
     
  21. The Property is furnished by the Property’s owner in accordance with the owner’s taste and style and SEJ takes no responsibility for any unmet expectations of guests, or any changes made by the owner to the décor, furnishings and equipment in the Property.
    While the property is fully furnished and well equipped, it may not have all appliances and equipment you may be used to using.
     
  22. Depending on the location of the Property, water may be supplied by a tank, bore or via the town’s main water supply. Town water is not available in Sandy Point or Waratah Bay. Guests are to use rainwater responsibly at all times as supply is limited. Guests with very young children and those who are concerned about drinking rainwater are advised to bring their own or purchase bottled drinking water. Water is available for purchase from the Sandy Point General Store and from other local supermarkets.
     
  23. Any repairs, maintenance or service that SEJ deems to be necessary for the Property or any equipment located at the Property, or any repairs, maintenance or service for the Property or any equipment located at the Property that is reported and requested by guests, will be effected as soon as practicable. However, due to unforeseen circumstances or reasons beyond SEJ’s control (e.g. awaiting parts, tradespeople unavailable) immediate repairs, maintenance or servicing may not be possible and SEJ accepts no responsibility for these circumstances. To the maximum extent permitted by law, no refund or compensation will be provided by SEJ due to the failure of any services, equipment or other contents provided at the Property. You must allow maintenance, repair or service personnel to enter the Property during reasonable hours by arrangement (and at any time in an emergency) for the purpose of conducting any maintenance, repair or service. Guests requesting a service call which is subsequently found not to be required will be charged the applicable service call-out fee.
     
  24. You are responsible for any damage caused to the Property or the loss of or damage to any items provided at the Property, including but not limited to the floors and floor coverings, furniture and fittings, kitchen utensils, crockery, glassware, cutlery and you must pay to SEJ the full cost of replacement or repair of any such items lost or damaged. All damage, breakages and losses are to be reported to SEJ immediately. All furniture and equipment must be left in the Property and as originally found.
    Any damage caused by you or your actions will be deducted from the credit card provided on the Guest Information Sheet.
     
  25. You are responsible for any costs incurred by SEJ for the re-tuning or re-programming of the TV or DVD player which have been de-tuned by you or by the attachment of your electronic devices, games consoles, play stations, Nintendo Wii’s etc.
     
  26. You are responsible for the safekeeping and replacement of accommodation keys. Duplicate keys are not always available. If keys or remotes are lost, you are responsible for the cost of changing locks.
     
  27. If you do not leave the Property neat and tidy, SEJ will charge you an additional cleaning fee. Any spillages, the fridge and kitchen benches must be wiped, dishes washed, dried and put away clean, BBQ cleaned (if used), and all garbage must be wrapped and placed in the garbage bin provided.
     
  28. You are responsible for placing all rubbish and recycling in the appropriate bins and leaving the bins out for collection on the appropriate day. Information regarding rubbish collection is provided at the Property, or you can contact SEJ’s office for information regarding rubbish collection days. Excess garbage, bottles and boxes will not be collected by the local council and must be removed and disposed of by you, or by prior arrangement with SEJ. Any associated costs must be paid by you.
     
  29. The Property must be vacated on time and secured with the windows and doors locked. All keys and key pouches must be returned to the key safe immediately after vacating the Property.
     
  30. You have the first option to request a booking for the Property for the same dates the following year but once you vacate the Property the option is no longer available. Re-bookings will only be accepted where your previous occupancy has been satisfactory and the Property owners have approved the requested dates.
     
  31. All rates are subject to change without notice, particularly in the event that the Property has been upgraded or renovated and on instructions from the owner, or in the event that the rate has been genuinely misquoted to you. If the rate has increased, you have the opportunity to pay the increased rate or obtain a full refund. Refunds will not be provided where the rate has decreased.
     
  32. In the event of any renovation or building work being carried out near the Property, such work is beyond the control of SEJ and SEJ does not accept any responsibility for any disturbance, noise or inconvenience you may suffer as a result. No discount will be provided in these circumstances.
     
  33. The Property may have a broadband internet connection (wired or wireless). The operation of any internet connection during your stay is not guaranteed and may be disrupted or unavailable. SEJ is not liable for the availability or disruption in any internet connection. TV reception in parts of Sandy Point can be unreliable due to weather conditions. Depending on the location of the Property, certain channels may be unavailable. You agree that you will not hold SEJ liable for any disruption to TV reception or for the unavailability of any TV channels.
     
  34. Any printed, electronic, written or verbal description of the Property or its location by SEJ or its employees is made in good faith and to the best of SEJ’s knowledge. To the maximum extent permitted by law, SEJ makes no warranties, express or implied, and disclaims all warranties, with respect to the Property, including without limitation any warranties of merchantability, fitness for a particular purpose or correspondence with description and SEJ is not liable to you for any errors or omissions relating to the description or location of the Property. Where SEJ’s liability to you cannot be excluded, SEJ’s liability is limited to a refund of the accommodation fee paid by you for the Property.
     
  35. Any information or terms and conditions contained in holiday brochures or websites are subject to change without notice, and to the extent of any inconsistency, these Terms and Conditions prevail.
     
  36. A $0.01 cent pre arrival authorisation check on the credit card given as security, in the Guest Information Sheet, will be done within 2 days prior to arriving to your booking.
